Why is K2 and "spice" legal?

So i my brother took 1 puff of some Spice and then he instantly he feel down and started having a stroke like thing. Then i watched the news and they are saying that the legal stuff is worse for you then the illegal stuff. Why don't they just make pot illegal? or just ban herbs like that all together?
